Terms of Sale
By transacting with San Francisco Wine Consulting, LLC, buyers and sellers agree to the following:
Age
You must be at least 21 years of age or older to purchase wine. By placing an order with SFWC, whether through email, over the phone or in person, you certify under penalty of perjury that you and the recipient are at least 21 years old. Upon delivery, the recipient will be required to show identification proving that he or she is at least 21 years old. SFWC will comply with any legal entity in the prosecution of anyone under the age of 21 attempting to buy alcohol.
Title
Title passes in the State of California from SFWC to the buyer at the time of purchase, or from supplier to buyer at the time of invoice/purchase for brokered transactions. SFWC acts as the buyer’s agent in brokered transactions and in arranging transport. The buyer affirms that when requesting that SFWC ship wine, he or she is acting in accordance with the laws of the State in which product is being delivered. Any shipment that is seized or destroyed due to violation of shipping laws or common carrier policy is the responsibility of the buyer and is not refundable.
Shipping
SFWC will endeavor to follow specific shipping instructions when such instructions are made available to SFWC. SFWC attempts to contact all clients prior to shipping to ensure there is a legally-aged recipient available to sign and accept shipment at time of delivery. SFWC opts to ship in the most economical way conducive with safe travel.
During transit, wines are insured for breakage, loss and theft. SFWC makes every effort to protect wines in transit by shipping to appropriate addresses, through reputable carriers, during cooler months, and often by temperature-controlled vehicles. SFWC does not accept responsibility for heat-related damage when shipped at the request of a client, and does not accept responsibility when leakage occurs in transit, which is frequently induced by overfilling or sudden changes in air pressure.
Holding Wine
SFWC will hold customer orders for modest periods of time on request or to avoid shipping during inclement weather, especially during the summer. This is done at no charge as a courtesy for our customers. Wine so held remains the property of the buyer. SFWC reserves the right to move wine to an alternate storage facility and/or to charge for the storage for especially large orders or for orders held for unreasonably ong periods of time.
Purchasing clients are encouraged to insure their wine under their own policies for wines stored for long periods of time. SFWC cannot be held responsible for damage to stored wine due to situations outside of its control such as acts of nature (flooding, earthquake, hurricane, etc.), structural or temperature-control failure of leased warehouse, or other occurrences outside of SFWC’s control.
Shipping Address
A street address at which an adult over 21 years of age or older is available during daytime hours to receive wine is required. We therefore recommend a business address wherever possible. Wine cannot be shipped to a P.O. Box or via the United States Postal Service. If wine is not accepted on the first delivery attempt, SFWC reserves the right to invalidate its quality guarantee as repeated delivery attempts may subject the wine to undue temperature stress.
International Orders/Shipping
SFWC cannot accept returns or refunds for wines shipped outside of the United States. We take particular care with packaging and scheduling International shipments – SFWC can insure international shipments for additional, yet nominal costs.
Bottle Conditions
When purchasing old and rare vintage wine, bottle condition and authenticity are of foremost concern. All of our old and rare vintage wine is sourced from well-maintained collections, trustworthy trade sources and wholesalers with established reputations. While SFWC shall make a diligent effort (including physical inspection and 3rd party consultation) to assess the condition of any wine, it is not always possible to know the complete provenance of every wine and SFWC makes no guarantee of a bottles authenticity, or soundness.
Liability/Insurance
Customer purchases that are temporarily stored for consolidation or weather hold, or wines stored by SFWC under brokered arrangements are covered in the event of negligence (droppage/breakage, loss, theft, etc.) SFWC also covers wines while in transit – either through its own insurance, or through chosen 3rd party carrier, should client opt to include additional insurance costs. SFWC is not responsible for loss as the result of acts of nature (flood, earthquake, hurricane, tsunami, fire/water damage or any other destructive natural force), acts of terror or warfare, or causes outside of its control such as structural failure of facility. Clients with large sums of purchased product under storage, or large sums of brokered or auctioned property are encouraged to insure wines under their own policies, or to sponsor additional coverage through SFWC’s insurance policy.
Representation of Suitability
While SFWC inspects each bottle of wine that it sells and endeavors to describe each bottle that it does not deem to be in excellent condition that might affect its drinkability, certain spoilage mechanisms are undetectable. SFWC makes no specific representation of drinkability of any particular bottle of wine. SFWC makes no guarantee of the suitability of any particular bottle of wine as an investment or for any other purpose.
Order Cancellation
If you make an error in ordering, please contact us immediately at info@sfwineconsulting.com. SFWC often purchases wines at the request of clients, or under brokerage arrangement, and therefore all orders are final. If order cancellation is requested, SFWC may impose cancellation fee of up to 20%, or will resell items at fair market value on behalf of purchasing client.
Taxes / Duties / Tariffs
Sales tax is charged for all non-trade orders shipped to addresses in California, including to storage facilities in California, orders picked-up at our facility, or delivered locally. Sales tax may be charged for shipments into other states where such laws apply. We urge customers to understand and comply with the sales tax laws within their respective State. Shipment to some countries outside of the United States require the payment of duties by the recipient. Recipients outside the United States are required to know and comply with the laws of their countries, and assume all responsibility. All taxes, duties, and tariffs (whether imposed prior-to, or after order placement/confirmation) are the sole responsibility of the buyer/customer and payment must be remitted prior to the release of the product. As is permitted by law, we will do our best to avoid client liability in regard to duties and tariffs in the event they are enacted after a pre-arrival order is placed and/or in-transit to the US, however, such circumstances are outside of our control and SFWC bears no responsibility or liability..
Availability and Pricing
Prices and availability are subject to change without notice. Due to variations in condition and sourcing, different bottles of the same wine may occasionally be posted with different prices. Our inventory is updated frequently and we make every effort to maintain accuracy in a timely fashion. Items are sold on a first-come first-served basis. Invoices, verbal and email confirmation notwithstanding, no item is guaranteed to be available until it has been pulled for shipping.
Errors
SFWC works very hard to accurately describe all products and provide world-class service in all aspects of its operation. Please contact us immediately if you believe an error has occurred and we will attempt to rectify it. Our maximum liability in any circumstance is limited to the purchase price of an item.
